1. Acceptance of terms
By accessing, registering for, or using any part of the aimeXM platform, you agree to be bound by these Terms of Service and our applicable policies. If you do not agree, you may not use the platform.
2. Service description
aimeXM provides tools for national examination management, including secure authoring, identity verification, serialised printing, exam-day operations, marking workflows, result publication and certificate verification. Features and availability may vary by deployment and subscription.
3. Account responsibilities
Organisations and authorised users are responsible for maintaining the confidentiality of credentials, ensuring accurate account information, and promptly notifying us of suspected unauthorised access. Individual users must act within the roles and permissions assigned by their organisation.
4. Acceptable use
You agree to use the platform only for lawful examination and administrative purposes. Prohibited activities include attempting to bypass security controls, interfere with other users, upload false or malicious data, reverse-engineer the platform, or use it in ways that violate applicable laws or examination regulations.
5. Data and content
Customer organisations retain ownership of their examination data subject to the platform's functional requirements. aime52 Ltd processes such data in accordance with the agreed data processing terms and applicable privacy policy, solely to provide and improve the service.
6. Intellectual property
aime52 Ltd and its licensors own all rights in the aimeXM platform, software, documentation, and branding. These Terms do not grant you any licence to copy, modify, distribute, or create derivative works of the platform except as expressly permitted.
7. Confidentiality
The platform is designed to handle commercially sensitive and examination-related information. Authorised users must treat all non-public information as confidential and may only disclose it to others with proper authorisation.
8. Limitation of liability
To the extent permitted by law, aime52 Ltd's liability for any claim arising out of these terms or the use of the platform is limited to the fees paid by the customer for the affected service in the twelve months preceding the event. Neither party is liable for indirect, consequential, or punitive damages.
9. Termination and suspension
We may suspend or terminate access where necessary to protect the platform, comply with law, or respond to a breach of these terms. Organisations may terminate their subscription in accordance with the applicable agreement. Upon termination, data is handled as set out in the data processing terms.
10. Changes to these terms
We may update these Terms of Service from time to time. Material changes will be communicated with reasonable notice through the platform or to the customer contact on record. Continued use after the effective date of changes constitutes acceptance.
11. Governing law
These terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Disputes will be resolved in the courts of England and Wales.
